LEGAL THEORY

This course addresses some fundamental questions about the theory of law, the nature of law in societies, and the impact of political, moral and social theories on ways of thinking about law. The course will address questions such as: Is law essential to social order? Are there different kinds of law? Do judges make law? Should law be used to enforce morality in private affairs? Why do people obey law? Is there a legal duty to obey unjust laws? What is the relationship between law and social change?  Are certain rights fundamental to a legal system?
